OVERVIEW

This website is operated by Pseudo New York. Throughout the Site, the terms “we,” “us,” and “our” refer to Pseudo New York.

Pseudo New York offers this website, including all information, products, services, and tools available through it, conditioned upon your acceptance of these Terms of Service.

By visiting pseudonewyork.com (the “Site”), purchasing from us, creating an account, or otherwise using our services, you agree to these Terms of Service and the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree to these terms, you should not access the Site or use our services.

1. ELIGIBILITY

Some products may be handmade, limited edition, preorder, or produced in small quantities. Minor variations that do not affect the intended use of a product may not constitute a defect.

Product availability is not guaranteed. We may limit quantities, discontinue products, modify designs, or withdraw products from sale at any time.

1. SIZING

Customers are responsible for reviewing the product description, measurements, sizing information, and available size guide before purchasing.

Sizing can vary between products. A size selected for one product might not fit identically to the same labeled size in another product.

Size exchanges are governed by our Return and Refund Policy and remain subject to inventory availability.

1. ORDERS

Discount codes and promotional offers are subject to their stated terms, expiration dates, product restrictions, and availability.

Unless expressly stated otherwise:

• Discounts cannot be combined.

• Discounts cannot be applied retroactively.

• Promotions have no cash value.

• Free-shipping promotions may exclude certain products or destinations.

• We may modify or end a promotion where permitted by law.

1. SHIPPING AND DELIVERY

Processing times, delivery estimates, shipping charges, free-shipping eligibility, international shipping, tracking, and address requirements are described in our Shipping Policy.

Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs authorities, weather, incorrect addresses, service interruptions, or other circumstances outside our reasonable control.

Customers are responsible for reviewing and confirming their shipping information before submitting an order.

1. INTERNATIONAL ORDERS

International customers are responsible for complying with the laws and import restrictions of their destination country.

Orders may be subject to customs inspections, duties, taxes, brokerage fees, or import charges. Unless collected during checkout, these amounts are the customer’s responsibility.

We cannot guarantee customs-clearance times or that every product can be legally imported into every destination.

1. RETURNS, EXCHANGES, AND REFUNDS

Returns, size exchanges, damaged products, incorrect products, order cancellations, store credit, and refunds are governed by our Return and Refund Policy.

   14.1 EMAIL MARKETING

   If you subscribe to email marketing from Pseudo New York, you may receive product announcements, promotional offers, restock notifications, and other marketing communications.

   You may unsubscribe at any time by selecting the unsubscribe link included in a marketing email. Unsubscribing from marketing does not prevent us from sending necessary transactional communications regarding your orders, payments, shipping, account, security, or customer-service requests.

   14.2 SMS/MMS MARKETING PROGRAM

   When Pseudo New York’s SMS program is available, you may enroll by submitting your mobile telephone number through checkout, a website form, a subscription tool, a keyword, or another clearly disclosed opt-in method.

   By voluntarily opting in, you provide your express consent to receive recurring automated SMS and MMS messages from or on behalf of Pseudo New York at the telephone number provided. The messages may be sent using an automatic telephone dialing system or other automated technology.

   You represent that you are the subscriber or authorized user of the mobile number provided and are authorized to consent to receive messages at that number.

   If your number is reassigned, canceled, or transferred to another person, you agree to unsubscribe or notify us promptly so messages are not sent to the new user.

   14.5 OPTING OUT

   You may revoke your consent and unsubscribe from SMS marketing at any time by replying STOP to a message.

   We will also honor other reasonable opt-out requests where required by applicable law, including words such as CANCEL, END, QUIT, REVOKE, OPT OUT, or UNSUBSCRIBE.

   After opting out, you may receive one final message confirming that your request was processed. You will not receive further SMS marketing messages unless you voluntarily enroll again.

   14.7 CARRIERS AND DELIVERY

   Participating wireless carriers are not liable for delayed or undelivered messages.

   Message delivery depends on your mobile carrier and network availability and is not guaranteed. Pseudo New York is not responsible for delays or delivery failures caused by carriers, network outages, unsupported devices, blocked numbers, incorrect contact information, or circumstances outside our reasonable control.

   Not all mobile devices, carriers, or geographic locations may support the SMS program.

   14.8 TELEPHONE NUMBER OR SHORT-CODE CHANGES

   We may change the telephone number, sender ID, or short code used for the SMS program. When required, we will provide notice or updated instructions.

   Messages or opt-out requests sent to a discontinued number might not be received. Always follow the instructions contained in the most recent message from us.

   14.9 PRIVACY

   Information collected through the SMS program is handled in accordance with our Privacy Policy:

   14.11 SMS PROVIDER TERMS

   The SMS application or service provider used by Pseudo New York may require additional disclosures or terms. Those provider-specific requirements are incorporated where presented during enrollment and apply alongside these Terms of Service.

If you subscribe to email marketing, you may unsubscribe at any time using the link included in our emails.

If you opt in to SMS marketing after that service becomes available, your participation will be governed by our SMS Marketing Terms. Consent to receive promotional messages is not a condition of purchase.

Transactional communications related to your orders, payments, shipping, security, or customer-service requests may still be sent when reasonably necessary.

1. PRIVACY

Our collection, use, retention, and sharing of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that your information may be processed by Shopify and other service providers involved in operating the store, processing payments, preventing fraud, fulfilling orders, and providing customer support.
